In Texas, Child Protective Services, also known as CPS, is part of the Department of Family and Protective Services (DFPS), and its job is to investigate any reports of child abuse or neglect. Once the investigation is concluded, they decide the right course of action to secure the safety of the child or children involved.
With court approval, CPS has the authority to visit homes, interview children and parents, and, in serious cases, remove children from their families, either temporarily or permanently.
CPS may get involved with a family in Texas after receiving a report of suspected abuse or neglect. Common reasons for an investigation include physical abuse, emotional abuse, sexual abuse, exposure to domestic violence, drug or alcohol misuse in the home, lack of adequate supervision, and unsanitary or unsafe living conditions.
It’s important to note that truancy and medical neglect can also lead to investigations. Even if the report is false or unfounded, CPS is obligated to assess any situation that could place a child at risk.
Once CPS receives a report of suspected abuse or neglect, it must assess whether the report meets the legal criteria for investigation. If it does, a caseworker will typically initiate contact within 24 to 72 hours, depending on the severity of the alleged risk.
The investigator can then visit the home, interview the child, parents, and others involved, and inspect the living conditions. CPS can also request medical or school records. If the caseworker finds evidence of risk to the child, they could offer support services to the family or petition the court for further action.
